The SA42 and 922R regulations????

Post by ScottD »

Is the semi auto MG42 subject to 922R compliance? If so, does a welded up German receiver count as a US part? ( it was scrap, I built it into a receiver...) What other parts count if necessary? Id hate to find out that Im walking into a grey area after all this work...

I did a quick google and see what you were talking about. However I found this saving grace....The M14 Receivers were not demilled to standard before re assembly. They never were truly destroyed. Even though they were now semi's, they were never destroyed as machine guns. My 4 cut German receiver was most surely demilled to spec! So, onward with my original question.......

Scott, this was a hot topic and there is/was a sticky on it.

BRP's SA42 is a FIREARM, not subject to 922r.

When Orin wrote Tech Branch, they too ruled it a FIREARM not subject to 922r, but then a few weeks later changed their minds. They now said it was a RIFLE because it accepted a shoulder stock.

So yes, its a rifle subject to the provisions of 922r.

And the receiver can't be imported, because its illegal to import receivers on a non sporting firearm or a machine gun. So I would say you manufactured the receiver here.

There is also another debate on what is a imported part and guys disagree and whats what.

I figured the following, but its my opinion only:

Buttstock
Charging Handle - Like a FAL and G3/Cetme
Barrel
Barrel Extension
Flash Hider
Bolt
Bolt Carrier
Grip Frame/Lower Receiver - Like a G3/Cetme
Pistol grip panels - Like a G3/Cetme

For US parts I have:

Receiver
Trigger
Hammer
Disconnector
Grip Frame/Lower Receiver
Pistol Grip

I don't think belts count, because its not a magazine (no body, follower or floorplate).

Well isnt that just great. Phuck me to tears. So what are we all using for US parts? Ive seen actual pics on this site of people using IZZY made FAL trigger parts, so obviously some of us are taking this issue more seriously than others. What are the US parts count in this weapon? (ie how much MORE money do I gotta spend??)

Salt, I'm confused now.\

The dates on your link are Jan06, while mine are Feb06.

I was under the impression that they are Rifles now, subject to 922r...correct?

No, yes, no, yes. Well, this sure makes things clear as mud.....One of the reasons I got away from gun plumbing a while back was because of this 922 ans AWB issues. Think the feds would buy it if I just took a sharpie and wrote US on all my parts? 8)

this all boils down to....... no more than 10 foreign parts.

There is no way to make a working SA42 with 10 foreign parts. It can't be done with any of the build methods I've ever seen on this board.

worst case scenario ,
Using a foreign FAL FCG. you still have to re-manufacture the hammer with a dremel into a new shape that won't work in a FAL, ......... it's now a US part, the trigger ......... add a MG42 trigger shoe, now it doesn't fit into a FAL anymore and ........... Its a US part. Semi-auto converted MG42 gripstick ............US part , doesn't fit on a MG42 anymore. SA bolt carrier ............ won't work in a , yadda yadda yadda you get the idea.

theres so much work done to these parts to make a legal closed bolt semi-auto that there are too few unaltered parts left to count against you in the foreign parts count game.
That doesn't mean we should give the BATFE a pass on an obviously wrong ruling but it just don't affect our builds.

Droolingidiot...........you make a good point. I just hope the ATF would see it that way. Somehow I doubt it. Still, Id hate to be the first person to get busted for 922 non compliance.

I will continue with my build. More questions to follow!

well, I have a US made buttstock on mine so that's one less foreign part. Sometimes it gets real tiresome jumping through gov. hoops. I"d like to make them jump through some of mine. How about locking them in a room with rainbow bil for a couple of days?

If you catch them in their own (Try a different word.),know the rules and know you are right, they don't know what to do.I had fun and never heard from them again. :D It helps if you don't care what happens. BTW-non-gun,non-firearms issue. They mistakenly thought I was a terrorist. The bad kind. :?

What is the latest on 922R and MG42 S/A? I have read that the Century M53 meets the 922R requirement and I haven't heard the part count or what parts are counted.

A receiver rewelded from parts of a properly demilled (torchcut) receiver from a previous foreign machinegun is considered a remanufactured part, and as such is considered as fabricated by the individually that rewelded it. So if you need to count parts for purposes of calculating compliance to 922r, a rewelded receiver wiould count as a domestically made part.
